Terms of Service

Effective date: 10 June 2026

Please read these Terms of Service in full before accessing Heduno. They are a legal agreement between you and us that governs your use of Heduno, including any Content, functionality and services offered on or through it. You may use Heduno only if you agree to this agreement. If you do not agree, you must not access or use Heduno.

1. Who we are and how to contact us

1.3 Where these Terms say we will contact you, we will do so by email or by message to your Account.

2. Definitions and interpretation

2.1 In these Terms, the following defined terms have the meanings given. These definitions are the canonical set for the whole agreement; every other instrument listed in clause 3 uses them with the same meaning.

2.2 Headings are for convenience only. "Including" and "for example" are not words of limitation. References to a clause are to a clause of these Terms unless stated otherwise. References to a named instrument are to the document of that name listed in clause 3.

3. The documents that form your agreement with us

3.1 Your agreement with us (the "Terms of Service") consists of these Terms of Service together with the following instruments, each of which forms part of your agreement to the extent it applies to you:

#InstrumentApplies to

(b)Creator TermsCreators

3.2 The Acceptable Use Policy (clause 6) is set out within these Terms and forms part of them.

3.3 If there is any conflict between these Terms and another instrument listed in clause 3.1, these Terms prevail unless the other instrument expressly states that it overrides these Terms on the specific point.

3.4 Defined terms used in any instrument listed in clause 3.1 have the meaning given in clause 2 of these Terms unless that instrument expressly defines them differently.

4. Eligibility, registration and account security

4.1 To use Heduno you must register an Account using a valid email address, a username and a password. Where we offer it, you may also secure your Account with additional authentication.

4.2 By registering you confirm that:

  • (a) you are at least 18 years old, and where the law of the country or territory in which you live sets a higher age for entering a contract with us or for accessing adult material, you meet that higher age; and

  • (b) you are permitted by the law of the country or territory in which you are located to use Heduno and to view the Content available on it.

4.3 You agree to provide information that is truthful, accurate and complete, to keep it up to date, and to provide any further verification records we reasonably require (including for age assurance under clause 5 and, for Creators, identity verification under the Creator Terms).

4.4 You are responsible for keeping your Account login details confidential and for all activity on your Account. You must contact us promptly at support@heduno.com if you believe your Account has been accessed without your permission.

4.5 You consent to receiving communications from us electronically in connection with your Account and your use of Heduno.

5. Age assurance and access to adult content

5.1 Heduno may make available adult (Not Safe For Work, "NSFW") Content. Heduno is not intended for and must not be used by anyone under 18 years old.

5.2 Until you are Verified, you may browse and use only non-adult (Safe For Work, "SFW") areas of Heduno. NSFW Content is not displayed or accessible to unverified Users, and direct links to NSFW Content do not bypass this restriction.

5.3 Age assurance is triggered at the point of your first purchase or Subscription. We use a "highly effective age assurance" process which is carried out by approved third party providers.

5.4 Pay-now-verify-later. Your purchase or Subscription completes even if you do not complete or pass age assurance at that time, but the Content remains locked and cannot be viewed through any route until you become Verified. You may return to complete age assurance at any time; once Verified, your locked Content (current and future) unlocks and your Verified status persists across sessions and across Creator domains.

5.5 Refund of a locked purchase. If your purchase or Subscription is locked because you have not completed age assurance, you may request a refund as set out in the Fan Terms. An approved refund is credited to your Wallet. This is in addition to your statutory rights.

5.6 We process age-assurance data to comply with our legal obligations to operate age assurance under the Online Safety Act 2023, and we keep records of age-assurance attempts (method, time, result and provider response). Where age estimation uses biometric data, we rely on the substantial-public-interest condition for that special-category data. Full details of lawful basis, the special-category condition and retention are in the Privacy Policy.

5.7 Access by jurisdiction. We may restrict, block or refuse access to Heduno, or to particular Content or features, in any country, territory or jurisdiction (including at the level of an individual US state) where we consider, acting reasonably, that providing access would be unlawful, would require compliance measures we have not implemented, or would expose us to legal or regulatory risk. We may use location-detection methods to apply these restrictions, and you must not seek to circumvent them. This clause does not affect the consumer protections set out in clause 16.2 for Users to whom we do provide access.

6. Acceptable Use Policy — prohibited content and conduct

6.1 This Acceptable Use Policy is the single canonical list of prohibited content and conduct on Heduno. The Community Guidelines and the Creator Terms refer to this clause rather than setting out their own lists.

6.2 You must not make available, request, or use Heduno to engage in any of the following. Some categories are unlawful; others are prohibited by us as a matter of policy.

Always unlawful and strictly prohibited:

  • (a) any Content that sexually depicts, exploits or endangers a person under 18 years old, or that is child sexual abuse material, whether real, simulated or generated;

  • (b) any Content depicting a real person without their consent, including non-consensual intimate images and "deepfake" sexual imagery of a real, identifiable person;

  • (c) Content or conduct that facilitates, promotes or arranges prostitution or human/sex trafficking, including sharing personal contact details to arrange in-person sexual services;

  • (d) Content depicting non-consensual sexual activity, serious violence, or sexual content involving animals;

  • (e) terrorist content, or content that encourages or facilitates terrorism;

  • (f) content that incites violence or hatred against people on the basis of a protected characteristic;

  • (g) content that encourages or assists serious self-harm or suicide.

Prohibited as a matter of platform policy:

  • (h) Content you do not own or have the rights to make available, or that infringes another person's intellectual property;

  • (i) impersonation of another person, or misrepresenting your identity or a Creator's identity (including failing to label AI personas as required by the Creator Terms);

  • (j) doxxing or publishing another person's private information without consent;

  • (k) fraud, scams, money laundering, or the sale of regulated or illegal goods (including weapons and controlled drugs);

  • (l) malware, spam, or attempts to disrupt, probe or circumvent the security or moderation systems of Heduno;

  • (m) circumventing age assurance, geographic or jurisdictional restrictions, or any access control, including by using a VPN, proxy, or any other method for the purpose of misrepresenting or concealing your location to bypass such restrictions;

6.3 Breach of this Acceptable Use Policy is dealt with under clause 7 (moderation and enforcement) and clause 11 (suspension and termination).

7. Our role: moderation, online safety and enforcement

7.1 We take an active role in keeping Heduno safe. We do not adopt a passive-host posture, and the following describes what we actually do.

7.2 Proactive moderation. Content uploaded to the Vault and sent as attachments is scanned by automated moderation before the upload completes. Content identified as nudity is classified as NSFW; Content in a prohibited category fails to upload. Automated moderation is supported by human review and by our internal moderation team.

7.3 Illegal content. We act to prevent Users from encountering priority illegal content and to remove illegal Content of which we become aware, in accordance with our duties under the Online Safety Act 2023 and, where they apply, equivalent obligations in other jurisdictions in which our Users are located. We report child sexual abuse and exploitation material to the National Crime Agency (including through its CEOP function) and the Internet Watch Foundation, to the US National Center for Missing & Exploited Children (NCMEC) where relevant, and to other competent authorities, in each case as required by law. We cooperate with law-enforcement investigations. Users can report illegal Content using the in-product "Report" function, which routes to our moderation team.

7.4 Protecting children. We operate the age-assurance measures in clause 5 to prevent under-18s from accessing adult Content.

7.5 Reporting and enforcement. Users can report Content or conduct using the "Report" function. Reports route into our moderation queue. Where Content or conduct breaches the Acceptable Use Policy or the law, we may, depending on severity, take action on a progressive basis — including warning, removing or restricting Content, applying our three-strikes process, suspending features, and suspending or terminating an Account. Serious or repeated breaches, and unlawful Content, may result in immediate action.

7.6 Outcomes and appeals. We will tell you the outcome of a report or enforcement action affecting you and explain how to appeal. Appeals are handled separately from the original decision under the Complaints & Appeals Policy.

7.7 Suspension pending investigation. We may suspend access to Content while we investigate a suspected breach. We will not be responsible for loss arising from action taken in good faith to investigate suspected breaches, subject to clause 13.

7.8 US Users. If you access Heduno from the United States, you are notified under 47 U.S.C. §230(d) that parental-control protections (including hardware, software and filtering services) are commercially available to help limit access by minors to material that is harmful to minors. This notice does not displace the online-safety framing in clauses 7.1–7.7, which applies to all Users.

7.9 EU and EEA Users — notice and action. If you are in the European Union or EEA, you (and any other person or entity) may notify us of Content you consider illegal using the "Report" function or by emailing support@heduno.com. A valid notice should identify the Content and its location, explain why you consider it illegal, and give your contact details (except for reports of offences concerning child sexual abuse). We will handle notices in a timely, diligent, non-arbitrary and objective manner, and a valid and sufficiently precise notice gives us knowledge of the Content concerned for liability purposes.

7.10 EU and EEA Users — statement of reasons, complaints and contact. Where we remove or restrict Content, suspend or terminate an Account or its monetisation, or take other action affecting an EU/EEA User on content grounds, we will provide a clear statement of reasons identifying what we did, the legal or terms-based ground, the facts relied on, and the means of redress, unless we are legally prohibited from doing so. You may challenge the decision free of charge through our internal complaint-handling system under the Complaints & Appeals Policy for at least six months, and you may also pursue out-of-court dispute settlement before a certified body or seek a remedy before a court. Our single point of contact for Users and for authorities on these matters is support@heduno.com; communications may be in English.

7.11 Trusted flaggers. We give priority to notices submitted by trusted flaggers awarded that status under the EU Digital Services Act, acting within their designated area of expertise.

7.12 Terms transparency. We apply and enforce these Terms and the Acceptable Use Policy diligently, objectively and proportionately, with due regard to the rights and legitimate interests of all parties, including freedom of expression.

8. Payments, Wallet and pricing

8.1 Following is free. You can Follow a Creator without a card and without payment.

8.2 Subscriptions are paid by card. Subscriptions are processed directly by card through our payment processor. Subscriptions renew automatically until cancelled; you can cancel at any time and your Subscription will remain active until the end of the paid period and will not renew after that. We provide pre-contract information, prominent renewal terms, renewal reminders and a straightforward cancellation route as described in the Fan Terms.

8.3 The Wallet. Other Payments — Pay-Per-View, tips, Custom Requests, Custom Offerings and paid messaging — are debited from your Wallet. You top up your Wallet by card. A top-up credits your Wallet immediately on successful payment; your Wallet balance cannot go negative; and if your balance is insufficient at the point of purchase you will be prompted to top up.

8.4 Pricing, currency and tax. Prices are displayed in US Dollars (USD). Prices shown to consumers are exclusive of any applicable value added tax, goods-and-services tax or sales tax. We account for tax as the deemed supplier of the digital content and services to Fans: for UK consumers we charge and account for UK VAT; for consumers in the European Union we account for VAT in the consumer's member state (through the VAT One-Stop-Shop); and for consumers in jurisdictions that tax digital services (including relevant US states), we charge and account for the applicable tax where we are required to do so. Tax is applied at the point of purchase (on Subscriptions, PPV, tips, Custom Requests and Custom Offerings), not at the point of Wallet top-up.

8.5 Refunds. Refunds (including refunds of locked purchases under clause 5.5) are credited to your Wallet and are dealt with in the Fan Terms, without prejudice to your statutory rights.

8.6 Unused Wallet credit. Wallet credit is intended for use on Heduno. You may request a refund of unused Wallet credit to your original payment method at any time; our payment processor may carry out reasonable identity and anti-fraud checks before processing it, and we may deduct any amounts you owe us. On closure of your Account, any remaining Wallet balance is refunded to you and is not forfeited. Wallet credits expire after 12 months of no account usage.

8.7 We may change our payment processor or providers where required, and we will continue to process Payments in accordance with these Terms.

9. Intellectual property and your Content licence

9.1 All intellectual property rights in the Platform and the services (other than Content) belong to us or our licensors and are licensed, not sold, to you for use in accordance with these Terms.

9.2 You confirm that you own, or have obtained all rights necessary to make available and to license, all Content you make available on Heduno.

9.3 Licence to us. You grant us a non-exclusive, worldwide, royalty-free licence to use your Content only to the extent reasonably necessary to operate, promote and provide Heduno — including to host, store, reproduce, display, transmit and make your Content available to Users, to add watermarks, text or stickers, and to create previews and thumbnails.

9.4 Duration and wind-down. The licence in clause 9.3 lasts while your Content is on Heduno and ends when your Content is removed or your Account is deleted, except that (a) we may retain copies as required by law or for the records described in the Privacy Policy, and (b) where Content has been distributed to a Fan or under clause 9.6, the licence survives only as far as necessary to honour that prior distribution.

9.5 We will not sell your Content. We may transfer the licence granted to us on a sale or reorganisation of our business.

9.6 Partner-network distribution (opt-in). We operate, or may operate, a network of sites on which Creator Content can be offered for sale. If you opt in, your Content will be offered across that network, on the terms presented to you at the time of opting in and subject to the terms of those sites. You can withdraw your opt-in for future sales at any time. Withdrawal does not affect any sale already made while you were opted in, and the licence in clause 9.3 survives, to the limited extent of clause 9.4(b), so far as necessary to honour Content already supplied to a purchaser on the network.

9.7 Moral rights. You waive your moral rights in your Content only to the limited extent necessary to allow us to add watermarks, text or stickers under clause 9.3. This does not affect your ownership of your Content or your right to prevent it being copied without permission.

9.8 Infringement notices. You grant us a limited right (but no obligation) to submit notices of infringement of your Content to third-party platforms on your behalf. We do not police infringement of your Content. Complaints about infringement of intellectual property rights on Heduno are dealt with under the DMCA / Copyright Policy and the Complaints & Appeals Policy.

10. Creator domains and links

10.1 Creator-operated domains. Some Creators (for example Heduno Max Creators) make Heduno available on their own domain (for example, insertname.com). Where a Creator operates such a domain:

  • (a) the Creator is responsible for registering and holding the domain and for any third-party costs associated with it;

  • (b) we grant the Creator a non-exclusive, revocable licence to use Heduno's services on that domain for the duration of the Creator's agreement with us, subject to these Terms;

  • (c) the single Heduno Account, Wallet balance and Verified status operate across all Creator domains; and

  • (d) on termination of the Creator's agreement with us, the licence in clause 10.1(b) ends, the Creator must promptly cease presenting the Heduno service on that domain, and we will allow a transition period of 30 days for the Creator to redirect or migrate the domain. We will handle data associated with that domain in accordance with the Privacy Policy.

10.2 Domains containing the Heduno mark. You must not register a domain containing the Heduno trademark or a confusingly similar term except with our prior written permission and under a licence; any permitted such domain must redirect only to the Creator's Heduno profile.

10.3 Links. You may link to Heduno fairly and lawfully, without suggesting any association or endorsement and without impersonating us. Links from Heduno to third-party sites are provided for convenience; we are not responsible for third-party sites.

10.4 Promoting your Account. Creators may promote their Account using lawful advertising and marketing, provided they do not impersonate Heduno, do not suggest that Heduno endorses them, and do not bid on or use the Heduno trademark in paid search or paid advertising without our consent.

11. Suspension and termination

11.1 We may suspend access to your Content or Account, or terminate your agreement with us, in the circumstances described in clause 7 and where:

  • (a) you have seriously or repeatedly breached these Terms or any instrument listed in clause 3, or threaten to do so in a way that could have serious consequences; or

  • (b) your conduct causes, or is reasonably likely to cause, loss to us or harm to Heduno's reputation or its Users.

11.2 We may also terminate your agreement for any other reason on 30 days' notice by email or message to your Account.

11.3 Where access to your Account is suspended, Payments that would otherwise fall due during the suspension are suspended, and we may withhold Creator Earnings not yet paid out, in accordance with clause 13 of the Creator Terms.

11.4 We will tell you about a suspension or termination affecting you and explain any right of appeal under the Complaints & Appeals Policy.

12. Account deletion

12.1 You can delete your Account in the Settings section of your Account.

12.2 If you are a Fan, deletion takes place within a reasonable period of your request. If you are a Creator, your Account remains open until the end of your subscribers' current paid Subscription periods, after which you receive your final payment and your Account is deleted.

12.3 On deletion you will no longer have access to your Account or its Content, and we may deal with your Content in accordance with the Privacy Policy. Active Subscriptions are handled as set out in the Fan Terms.

12.4 Any remaining Wallet balance on deletion is refunded to you and is not forfeited (see clause 8.6).

13. Our responsibility for loss or damage

13.1 We will use reasonable care and skill in providing Heduno.

13.2 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded by law.

13.3 Subject to clause 13.2, and to the extent permitted by law, we are not liable for: loss or damage caused by other Users or their Content; loss or damage not caused by our breach of these Terms; loss or damage caused by your own breach (including failure to keep your Account secure); or loss that was not a reasonably foreseeable consequence of our breach at the time this agreement was formed.

13.4 If you use Heduno as a Creator (and not as a consumer), to the extent permitted by law we are not liable for loss of profits, sales, business, contracts, anticipated savings, goodwill or reputation, or for indirect or consequential loss.

13.5 Subject to clause 13.2, our total liability under this agreement will not exceed the higher of (a) the total amount you paid for Paid-for Services in the 12 months before the event giving rise to the liability, or (b) £1,000. "Paid-for Services" means Subscriptions, PPV, Custom Requests, Custom Offerings and paid messaging purchased by you through Heduno. The cap in this clause does not apply to, and does not limit, our obligation to pay Creator Earnings properly due to a Creator under the Creator Terms.

13.6 The cap in clause 13.5 does not limit your statutory rights as a consumer or any liability that cannot be limited under clause 13.2.

14. Events outside our control

14.1 We are not liable for any failure or delay in performing our obligations caused by an event beyond our reasonable control (including industrial action, civil unrest, war or terrorism, fire, flood, pandemic or epidemic, natural disaster, or failure of telecommunications networks). Our obligations are suspended for the duration of the event and we will take reasonable steps to minimise any delay.

15. Changes to Heduno and to these Terms

15.1 We may update Heduno from time to time and may suspend, withdraw or restrict its availability for business or operational reasons. We will give reasonable notice of any major change or suspension that affects you where we can.

15.2 We will give you reasonable notice of changes to the Terms of Service, by email or through Heduno, and you may end your agreement with us before the changes take effect. Once updated Terms are in effect, continuing to use Heduno means you accept them. Where a material change is made, we will ask existing Users to re-accept.

15.3 We may make a change without prior notice only where it is required by law or regulation on a timescale that does not allow notice, or to address an unforeseen and imminent security or fraud risk; we will tell you as soon as we reasonably can afterwards.

16. Governing law, jurisdiction and your consumer rights

16.1 These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.

16.2 Consumer carve-out. If you use Heduno as a consumer, nothing in clause 16.1 deprives you of the protection of any mandatory consumer-protection laws, or of the right to bring proceedings in the courts, of the country or territory in which you live.

17. General

17.1 If any provision is found unenforceable, the rest of the agreement remains in effect.

17.2 If we do not enforce a provision, that is not a waiver of it.

17.3 You may not transfer your rights or obligations without our prior written consent. We may assign or transfer our rights and obligations (for example, on a merger, acquisition or sale of assets) and may delegate performance, remaining responsible to you for it.

17.4 This agreement does not create rights for third parties, except that our exclusions and limitations of liability may be relied on by our group companies, employees, owners and agents.

17.5 The Terms of Service form the entire agreement between you and us regarding your use of Heduno and supersede any prior understandings.
